BACOLOD City – Wilson Gamboa Jr. “disrespected” the Sangguniang Panlungsod for holding a public hearing on a subject that was not referred to him, four of his colleagues said.

The history, culture and arts committee chairman “failed” to seek authority to hold the public hearing on House Bill No. 5875, councilors Caesar Distrito, Em Ang, Cindy Rojas, and Dindo Ramos said in a statement released yesterday.

Gamboa held on Nov. 9 a public hearing on the bill, which seeks to declare June 18 of every year as the Bacolod City Charter Day and make it a local special nonworking public holiday.

“Nobody will question your sacred duty if it is within the provisions of the law and the internal rules of the Sanggunian,” the four councilors said, addressing Gamboa.

They said Section 1, Rule VI of their Internal Rules of Procedure states that, “a committee may consider, investigate and take action on matters that are assigned by the Sangguniang Panlungsod.”

“What he (Gamboa) did was a blatant display of disrespect to the policy-making body in which he is a part of, given that the subject matter of his public hearing was never referred to his committee,” they said.

Gamboa “disregarded the authority of the august body” when he “failed to ask for an authority from the Sanggunian to conduct such hearing in aid of legislation,” they added.

Earlier Gamboa said that he conducted the hearing to be “enlightened” and that he would not have a stand on the bill until legal and historical issues surrounding it are resolved.

Any matter should be appropriately assigned or referred first to the committee before councilors can take action on them, “not the other way around,” said the four councilors.

In a statement released on Wednesday, Gamboa said, “There is no rule or any provision in the internal rules or any law that prohibits any member of the [city council] to conduct a public hearing on matters involving public interest, more so if the issue is related to his/her committee.”

Has Gamboa “conducted a committee hearing [on] subject matters that were not included in the agenda of the Sanggunian?” The four councilors wanted to know.

“As far as we can remember, he was among those who questioned former councilor (Carlos Jose) Lopez why he conducted consultative meetings with market vendors without authority from the Sanggunian,” they said.

Earlier the city council passed a resolution supporting House Bill No. 5875, which was authored by Rep. Greg Gasataya.
