BACOLOD City – Vice Mayor Robert Acaling of E.B. Magalona, Negros Occidental filed a complaint against E.B. Magalona mayor Marvin Malacon and six members of the Sangguniang Bayan (SB) before the Office of the Ombudsman.

Acaling accused Malacon and the SB members of violating sections 3, 5 and 7 of Republic Act 3019, or the Anti-Graft and Corrupt Practices Act.

The accused SB members include Joey Pugales,ReylanGamboa Sr.,Isidro Gomed,Eric Matulac, GelitaParcon, and JovieMadayag.

The local officials are also punishable under articles 217 and 220 of the Revised Penal Code.

In a press conference yesterday, Acaling said he filed the complaint because of his conscience.

The complaint was in relation to the allegedly corrupt use of the town’s public funds and abuse of authority of the local officials.

According to Acaling, Malaconcapriciously utilized the town’s fund even without being granted the SB’s approval.

Acaling added that Malacon would sometimes call for special sessions with some members of the SB without informing him.

The vice mayor also claimed that the Malacon used 20 percent of the Municipal Development Fund for projects that the SB never approved.

Malacon entered into an agreement with the Land Bank of the Philippines (LBP) to set up an ATM machine at the municipal hall without securing authority from the SB, Acaling added.

According to Acaling, Malacon recently negotiated with the LBP a loan worth some P200 million for the purchase of heavy equipment for the town’s public market.

The mayor also sourced P3 million from the Municipal Development Fund as advance amortization for the proposed loan, said Acaling.

“It is high time that such illegal acts considered prejudicial to the interest of the people of E.B.Magalona be put to a stop,” Acaling added./PN
