MANILA – The Office of the Ombudsman has indicted former Moises Padilla, Negros Occidental mayor Francisco Nazareno for his failure to disclose two of his business interests in his statements of assets, liabilities and net worth (SALN).

Ombudsman Conchita Carpio-Morales said Nazareno faces charges for four counts of violation of Section 8 of Republic Act (RA) 6713, or the Code of Conduct and Ethical Standards for Public Officials and Employees, and two counts of violation of Section 3(h) of RA 3019, or the Anti-Graft and Corrupt Practices Act.

According to Ombudsman investigators in Iloilo City, Nazareno did not include in his SALN two of his business interests – the JF Merchandise and Juco Enterprises – which were registered in his and his wife’s name, respectively, from 2007 to 2010.

Nazareno has served as mayor for two terms, from 2007 to 2013.

Section 8 of RA 6713 states that, “Public officials and employees have an obligation to accomplish and submit declarations under oath of, and the public has the right to know, their assets, liabilities, net worth and financial and business interests including those of their spouses and of unmarried children under eighteen years of age living in their households.”

Section 3(h) of RA 3019, on the other hand, prohibits public officials from “directly or indirectly having financing or pecuniary interest in any business, contract or transaction in connection with which he intervenes or takes part in his official capacity, or in which he is prohibited by the Constitution or by any law from having any interest.”

The Ombudsman said Nazareno committed graft when he approved the mayor’s permits for JF Merchandise and Juco Enterprises despite having ties in both businesses.

“Both businesses were not listed in Nazareno’s SALN,” Carpio-Morales said. “The two were also given business permit during Nazareno’s incumbency, which violates RA 3019.”
