MANILA – Former president Benigno “Noynoy” Aquino III once again put the blame on Getulio Napeñas for the antiterrorism operation in Mamasapano, Maguindanao in 2015 that led to the death of several police officers.

Napeñas was then heading the Philippine National Police-Special Action Force (PNP-SAF) that operated against the wanted terrorist Zulkifli bin Hir, alias Marwan. Forty-four troopers died during the encounter.

On Friday the Office of the Ombudsman ordered the indictment of Aquino for usurpation of authority and graft for allowing the suspended PNP chief Alan Purisima to get behind the operation dubbed Oplan Exodus.

Napeñas should be blamed for the operation, the former president insisted in a press statement released Sunday.
“I asked Napeñas that he needs to coordinate with the AFP (Armed Forces of the Philippines) to prepare everything that will be needed in the operation but he disobeyed me,” Aquino said.

“My only mistake here is that I trusted Napeñas. I cannot fathom that a police official like Napeñas, who I personally promoted to a two-star general, will lie and disobeyed me,” he added.

Ombudsman Conchita Carpio-Morales said Aquino committed the violations for allowing Purisima to participate in Oplan Exodus while fully aware than the latter was suspended.

Aquino said his camp will file a motion for reconsideration against the Ombudsman order before the deadline on Wednesday.

But Morales dismissed the charges of reckless imprudence resulting in multiple homicide against Aquino for “lack of probable cause.”

The families of the commandos who died in the encounter, or the so-called SAF 44, were not happy, said their lawyer, who also criticized the Ombudsman for “saving the skin of her political patron and godfather.”

The Volunteers Against Crime and Corruption filed in July and August last year charges for reckless imprudence resulting in multiple homicide against Aquino, Purisima and Napeñas.

“I just wonder how the Ombudsman arrived at the resolution when all in-depth inquiries into the Mamasapano massacre have unfailingly pointed the ultimate finger of culpability at none other than … Aquino for the death of 44 policemen,” said Atty. Ferdinand Topacio.

“Now, these 44 deaths are only equivalent to graft, as if Mr. Aquino only stole a pencil from government?” Topacio said. “How is that acceptable to mothers and fathers who have lost their children, wives who have lost husbands, and children who have lost fathers?”

“The Ombudsman misapplied the law,” he added. “A person who has set in motion a certain chain of events that led to deaths of other persons is liable for reckless imprudence resulting to homicide.”/PN
