MANILA – The Office of Ombudsman upheld its order to file criminal charges against former president Benigno “Noynoy” Aquino III for his role in the fatal antiterrorism operation in Mamasapano, Maguindanao in 2015.

It dismissed the motion to drop the charges for usurpation of authority and violation of the Anti-Graft and Corrupt Practices Act against Aquino, Ombudsman Conchita Carpio-Morales said in a statement on Thursday.

Aquino was “fully aware that the Office of the Ombudsman had placed (dismissed Philippine National Police chief Alan) Purisima under preventive suspension at the time [for the anomalous Werfest deal],” Morales said.

“At the time, particularly before and during the actual implementation of Oplan Exodus, Purisima was under preventive suspension, and Purisima, despite being under preventive suspension, indeed played an active role in Oplan Exodus,” she added.

Wanted terrorist Zulkifli bin Hir, or “Marwan,” 44 Philippine National Police’s Special Action Force (SAF) operatives, and dozens of civilians and rebels died in that operation.

According to Morales, the exchange of text messages between Aquino and Purisima about the planned antiterrorism operation was “huge evidence” that the former allowed the latter to join Oplan Exodus.

It was also because of Aquino’s influence and permission that Purisima was able to participate in planning Oplan Exodus despite the latter’s preventive suspension, she said.

Earlier the Ombudsman found probable cause to indict Aquino for conspiring with Purisima and dismissed SAF director Getulio Napeñas.

But Aquino was absolved from the charges for reckless imprudence resulting in multiple homicide and physical injuries.

In his motion, Aquino said the Ombudsman’s conclusions were based on “highly inaccurate and flawed facts.”

Aquino insisted that his exchange of text messages with Purisima cannot be construed as asking or ordering the latter to direct Oplan Exodus, claiming he was just “a passive receiver of updates.”/PN
