SURPRISES can often times be fun, but there can be no fun when you are confronted with a surprise that you are married when in fact you have never been married.
What could be a possible remedy when you find out there is a registration of marriage existing under your name even if you have never been married?
There’s a recent Supreme Court decision; a woman, on the day of her application for a certification of no marriage, found out she has been married to someone she doesn’t even know.
The court decided that in the absence of a marriage, which existed, but no celebration or consent was present, the required essential requisite under Article 3 of the Family Code was not complied. Hence, the existing registered marriage is void ab initio.
Commonly, a Petition for Declaration of Nullity of Marriage is required to declare a marriage void ab initio. However, it was settled in this case, where no celebration to speak of existed, a mere correction of entries shall suffice as a valid remedy.
In life, we are confronted by many surprises and sometimes we feel we have to take the long resort to seek resolutions for these awful surprises. But if we just learn to positively seek God’s intervention, we will realize that there a better and less burdensome way for these troubles.
