ILOILO City – A policewoman of the Maayon, Capiz police station was dismissed from the service. She was found guilty of grave misconduct.
Nine years ago Police Officer 3 Cleofe Diaz was charged administratively for allegedly beating up a man.
Just this Aug. 4, 2017 the National Police Commission (Napolcom) en banc ordered her dismissal from the service but the decision reached the Commission’s Western Visayas office only on Nov. 13.
The complainant was Barangay Poblacion, Maayon resident Antonio Delfin who had a dispute with Diaz’s father Bendito Dumot.
According to Delfin, a verbal confrontation with Diaz around 6 p.m. on Sept. 7, 2008 became physical.
He claimed Diaz slapped his face and hit his head with a handcuff then tried to handcuff him.
Delfin claimed he ran away to escape further harm and as he was fleeing Diaz fired a gun at him.
Diaz denied Delfin’s allegation and claimed the man was in fact the one who attacked her and that she was forced to defend herself.
The administrative complaint against her, added Diaz, was Delfin’s countercharge to her complaint against him for direct assault and attempted murder filed before the Capiz Provincial Prosecutor’s Office.
Napolcom, however, believed Delfin more than Diaz. The man was only armed with a slingshot while the police officer had a gun, it noted.
“Self-defense as an alibi is inherently weak and viewed with disfavor because it can easily be concocted and fabricated,” according to the Napolcom.
This defense, if not substantiated by clear and convincing evidence, are “negative and self-serving and are undeserving of weight in law. Positive testimony normally enjoys more weight than negative testimony that asserts the same facts do not exist,” added Napolcom.
The decision was signed by Atty. Rogelio Casurao, commissioner, and Vice Chairman and External Officer commissioners Felizardo Serapio and Zenonida Brosas.
Napolcom Region 6 pre-charge investigator Allen Camering said Diaz has yet to receive the decision and she has the right to file an appeal./PN
