BACOLOD City – The Civil Service Commission (CSC) central office in Manila declared illegal the termination of a regular employee of the Talisay City local government unit (LGU).
The CSC said Mayor Jesus Antonio Neil Lizares has erred in approving Jay Ann Dolendo’s dismissal papers.
Dolendo is entitled to reinstatement in the Talisay LGU and payment of back wages and benefits covering the period Aug. 1, 2016 to April 12, 2017, the CSC order stated.
On Nov. 6, CSC chairperson Alicia dela Rosa-Bala and commissioners Leopoldo Roberto Valderosa Jr. and Robert Martinez penned a 5-page decision explaining the illegality of Dolendo’s dismissal from the service.
“The termination of Dolendo from service is not in order because there was no violation of the assumption to office…and there is no basis to consider her dropped during her probationary period,” the CSC decision stated.
Talisay City LGU records showed that Dolendo was promoted to regular status as the computer operator 1 assigned at the Human Resource Management Office (HRMO) on Feb. 23, 2016.
That time, Eric Saratan was the city’s mayor.
Lizares then assumed the mayor’s position and removed Dolendo from the city hall on Aug. 1, 2016.
Lizares said Dolendo failed to perform her duties as the computer operator 1 at the HRMO.
Lizares added that Dolendo was still a probationary employee and thus the latter can be removed from her position at any time before the expiration of her “probationary period” for lack of capacity and unsatisfactory conduct.
On Aug. 23, 2016, Dolendo filed an appeal before the CSC Region 6 challenging her termination.
CSC field office in Negros Occidental on Oct. 11, 2016 disapproved Dolendo’s appointment at the Talisay City LGU for violation of the prohibition on the issuance of appointment prior to the elections.
Dolendo lodged another appeal before the CSC Region 6 on Oct. 24, 2016 assailing the disapproval of her permanent appointment.
Acting on her two appeals, the CSC Region 6 favored Dolendo.
Lizares filed a motion for reconsideration against the CSC Region 6 decision before the CSC central office.
The CSC central office said it is not convinced with Lizares’ appeal, citing that “Dolendo reported and functioned as computer operator 1 at the HRMO.”
The CSC added that it “cannot interfere with the Saratan’s prerogative to regulate all aspects of employment relating to employees.”/PN
