PBBM vetoes BCDA bill amendment

MANILA – President Ferdinand “Bongbong” Marcos Jr. has vetoed a bill that amends the Bases Conversion and Development Authority (BCDA) charter.

In a statement over the weekend, Malacañang said the Chief Executive rejected the proposed changes to the BCDA charter because of potential conflict with existing laws and adverse impact on the government’s fiscal position.

“Although President Marcos recognized Congress’ noble intention in crafting the bill, he said he could not ignore the concerns raised by the national agencies,” stressed the statement released through the Presidential Communications Office.

In his veto message, the President expressed apprehension regarding certain provisions of the enrolled bill, particularly the suggested increase of P100 billion in authorized capital, stating that it may compromise the fiscal integrity of the government.

Marcos indicated that the plan to allocate the proceeds from the sale of designated lands within the ecozones primarily to the BCDA is “inconsistent” with the government’s one-fund policy, thereby restricting its fiscal flexibility in addressing more urgent issues.

“In addition, the bill antithetically grants to the BCDA the authority to determine alienable and disposable lands, which clearly falls under the mandate of the Department of Environment and Natural Resources,” Marcos said.

He added that the bill’s language granting land ownership and authority to the BCDA in disposing of lands also contradicts Republic v. Heirs of Bernabe, which provides that the state is the beneficial owner of the lands transferred to the BCDA under Republic Act (RA) 7227, or the Bases Conversion and Development Act of 1992.

The BCDA continues to play a significant role in generating economic opportunities within the nation by developing integrated projects, active business hubs, and thriving communities.

It collaborates with private entities to advance essential public infrastructure, including toll roads, airports, seaports, and substantial real estate initiatives.

Over the years, the BCDA has established itself as one of the most effective government agencies in drawing investments, generating employment for Filipinos, and enhancing the Philippine economy./PN
