ILOILO – The opportunity may be lost for the poor fish vendors of Dumangas town to benefit from the proposed Pasalubong Center in Sitio Pantalan, Barangay Dacutan due to the continuing inaction among local officials of the town.

The Pasalubong Center project was funded at the initiative of APPEND party-list’s Rep. Pablo Nava III under the fiscal year 2015  Infrastructure Program of the Department of Public Works and Highways (DPWH) based on the General Appropriations Act.

The implementation of the project hinges on the acquisition by the local government unit of Dumangas through expropriation of the 2,000 square meters privately-owned lot.

“Expropriation is being resorted to after negotiations to acquire a 2,000 square meters portion of Lot 520 owned by Feliciano Divinagracia and Company have failed,” said Nava.

He noted that several representations were made with the incumbent Dumangas local officials explaining the essential requisites for Dumangas municipal officials or barangay officials of Dacutan to pursue expropriation proceedings, among these are as follows:

a) An Ordinance is enacted by the local legislative council authorizing the local chief executive to pursue expropriation proceedings over a private property;

b) The power of eminent domain is exercised for public use, purpose or welfare;

c) There is payment of just compensation as required under Section 9, article III of the Constitution.

Nava further noted that “per the current tax declaration of said Lot 520 its ‘adjusted market value’ is only P3,293,800.32 or only P91,636.99 of 2,000 square meters, and the 15 percent of which needed to take immediate possession is only P13,745.50.”

It was disclosed that as early as Nov. 4, 2016 Nava had written Dumangas mayor Ronaldo Golez and Vice Mayor Ian Dolutan and all members of the Sangguniang Bayan of Dumangas.

 He appealed “for this last opportunity for our town to be benefitted” by this funded project to serve as Pasalubong Center, Rest Areas, Parking Spaces and Vending Spaces for the poor who make a living from selling aquatic and fishery products that Dumangas is famous for./PN
