ROXAS City – For grave misconduct, a police officer was dismissed from the service in this city.

The National Police Commission (Napolcom), through its 7-page decision, ordered the termination of Senior Police Officer 3 Cleofe Diaz on Aug. 4.

Diaz received the dismissal order on Monday, according to Allen Camering, spokesperson of Napolcom Region 6.

“Diaz is given 10 days to appeal. If not, this decision will be final,” said Camering.

Napolcom’s Case No. R6-09-016 was from the complaint that Antonio Delfin of Sitio Badlan, Barangay Poblacion Ilawod, Maayon, Capiz filed nine years ago.

Delfin filed the administrative complaint against Diaz for “taking advantage of her position as a police officer,” the decision said.

Delfin was driving a motorcycle on his way home at around 6 p.m. on Sept. 7, 2008 when Diaz – on board a motorcycle – confronted him, the complaint stated.

Earlier that day, Delfin and Diaz’s father had an argument over the ownership of ducks.

Diaz slapped and hit Delfin using a handcuff and shot him four times using her service firearm, the complaint stated.

Diaz also had Delfin “incarcerated for three days without legal basis.”

Diaz had denied the allegations, calling them “fabricated and self-serving.”

She claimed that it was Delfin who attacked her first.

But Napolcom favored Delfin citing that “public officials and employees serving the government should at all times respect the rights of others.”

According to the Napolcom, Diaz has “failed to observe her obligation in the exercise of her function to act with courtesy, self-restraint and civility when dealing with the public, even when she was confronted with stubbornness.”/PN
