BACOLOD City – The Commission on Elections (Comelec) en banc denied a motion for reconsideration that Monico Puentevella filed in relation to his electoral protest after losing the mayoralty bid to Evelio Leonardia last year.
Puentevella filed the motion on Aug. 24, 2016 after the Comelec, thorough an Aug. 18 order, dismissed his protest for insufficiency in form and content, pursuant to Rule 6 of Comelec Resolution No. 8804.
Comelec chairman Juan Andres Bautista, along with all five commissioners, signed the six-page order denying the motion and affirming the Aug. 18 protest dismissal.
“… [T]he Motion for Reconsideration failed to raise matters sufficiently persuasive to warrant the reversal of the assailed Order,” the order, which was promulgated on Sept. 14, said.
It added that Puentevella’s arguments in the motion were just a “mere rehash of all the factual and legal issues stated in his Protest.”
In the May 9, 2016 elections, Puentevella lost to Leonardia on a 22,238-vote difference.
On May 20, Puentevella filed before the Comelec the dismissed electoral protest.
Puentevella said the dismissal deprived him of his right to due process.
