BACOLOD City – A mall in Barangay Mandalagan was given five days to explain to the Office of the Building Official (OBO) why it has not yet complied with its several construction deficiencies.
Failure to do so, OBO head Isidro Sun Jr. said, will “compel” him to “suspend/revoke” the mall’s certificate of occupancy.
Sun reminded CityMall project-in-charge Reynaldo Tenedero that the “undertaking” the latter signed stated that “all … [construction] deficiencies shall be complied with per built plan within 30 days from Nov. 8.”
Among such deficiencies were restroom for persons with disabilities on the ground floor; as-built second floor plan; mechanical as-built plan; and sewage treatment plant, cistern and rainwater collection tank.
The OBO issued CityMall an occupancy permit on Nov. 9 after Tenedero executed the undertaking.
But “your company failed to comply [with the deficiencies] as [of] this date,” Sun wrote Tenedero on Monday, Dec. 12.
Sun also reminded Tenedero that his undertaking stated that “if this undertaking is not complied with within the period requested, then our company, CityMall Mandalagan Bacolod, is willing to have its permit of occupancy suspended.”
“In view of this, you are given five days to explain why you have not complied [with] the requirements as stipulated in your undertaking,” Sun said. “Failure to do so will compel the undersigned to suspend/revoke your occupancy permit.”
Tenedero has refused to comment on the letter-notice.
Panay News reached CityMall manager Ronald Paglumotan for comment, but he refused. Some mall tenants also told this reporter they had nothing to say.
Earlier Sun warned of a “domino effect” if CityMall’s certificate of occupancy gets revoked.
If that happens, Sun said he will recommend to the City Legal Office the closure of the entire establishment. While its business permit may still hold, such may not be renewed without the occupancy permit, he said.
And the tenants, which were set to renew their business permits next year, may bear the brunt, said Sun./PN
