ILOILO – Two barangay kagawads in Ilaya, Pontevedra, Capiz were suspended for three months.
The Office of the Ombudsman Visayas found Marilyn Delfin and Marites Borro guilty of simple misconduct for preventing a recipient of financial aid for super typhoon “Yolanda” survivors from leaving the municipal hall.
Delfin and Borro — along with Ma. Lyle Cortel, a barangay day care worker — were also charged with grave coercion.
Sometime in August 2015 resident Mildred Vargas and her daughter went to the municipal hall to claim their P30,000 financial assistance under the Emergency Shelter Assistance (ESA), said the Ombudsman.
Of the amount, “P10,000 would be given to barangay officials … for the benefit of other residents who could not avail [themselves] of the cash assistance,” the Ombudsman said, citing Vargas.
After Vargas received the money, the barangay officials “forcibly prevented” her and her daughter from leaving until they turned over the money.
“After a brief scuffle, P9,500 was taken by respondents, with a measly P500 returned to Vargas,” said the Ombudsman.
“Borro and Delfin’s act of preventing complainant and her daughter from leaving the premises of the municipal hall against their will was not made under authority of law or in the exercise of a lawful right,” Deputy Ombudsman Paul Elmer Clemente said in a press release.
“Even granting that complainant agreed to share a portion of the cash assistance she received from the government, the same is not a sufficient justification for respondents to use force or violence against complainant’s daughter and prevent her from leaving the municipal hall until she would give the amount of P10,000,” Clemente said.
Clemente directed the Department of the Interior and Local Government to serve the suspension order./PN
