MANILA – The Department of Justice (DOJ) on Friday filed three separate charges against Sen. Leila de Lima in relation to her alleged involvement in the illegal drug trade at the New Bilibid Prison (NBP) in Muntinlupa City.
Aside from de Lima, also facing drug charges before the Muntinlupa City Regional Trial Court are her co-accused led by former Bureau of Corrections (BuCor) director Franklin Bucayu.
The respondents were charged with violation of Section 5 (sale and trading of illegal drugs) in relation to Section 3 (jj), Section 26 (b) and Section 28 (criminal liability of government officials and employees) under Republic Act 9165, or Comprehensive Dangerous Drugs Act.
The case filed against de Lima and her cohorts is the result of the preliminary investigation conducted by a five-man DOJ panel on complaints filed by the National Bureau of Investigation (NBI), the Volunteers Against Crime and Corruption, former NBI deputy directors Reynaldo Esmeralda and Ruel Lasala, and inmate Jaybee Sebastian.
As of 3 p.m. on Friday, the Muntinlupa City RTC has yet to raffle the case against the former DOJ secretary to a judge that has jurisdiction to issue a warrant of arrest against the accused.
The case was filed hours after the Court of Appeals (CA) Sixth Division junked the request of de Lima to stop the DOJ from deciding on the complaints against her due to alleged failure to show that she will suffer irreparable loss if her appeal is not granted.
De Lima has been accused of tolerating and benefitting from the illegal drug trade inside the national penitentiary when she was still the DOJ secretary. She allegedly received kickbacks from drug lords detained at the NBP.
President Rodrigo Duterte had earlier said that de Lima and her driver Ronnie Dayan are responsible for the illegal drug trade inside the national penitentiary with the then DOJ secretary using her driver as her “bagman”.
De Lima and Dayan were further implicated by the NBP inmates who testified before the House of Representatives and de Lima’s security aide Joenel Sanchez./PN
