BACOLOD City – The Office of the President has ordered Mayor Evelio Leonardia to submit his verified answer on a complaint filed against him.
Sarah Teresa Esguerra on April 6, 2017 filed a complaint on the alleged failure of Leonardia to execute Resolution No. 061312 of the Civil Service Commission (CSC) National Office.
In her complaint, Esguerra cited that the resolution invalidates the co-terminus appointment of the late Atty. Allan Zamora, who was at that time City Legal Officer of Bacolod.
The complaint also said Leonardia deliberately ignored and boldly defied the resolution. He, instead, continued the engagement with Zamora until he died on March 5, 2009.
Esguerra added that the mayor’s defiance has caused unauthorized disbursements for the salaries of Zamora.
“This is even against the advice of a disallowance by the Commission on Audit to the continued payment of Zamora’s compensation after the said CSC resolution,” the complainant said.
‘RECYCLED CASE’
According to City Legal Officer Joselito Bayatan, the complaint is a “recycled case” since the decision of the CSC has already been resolved by the Regional Trial Court (RTC) and the Court of Appeals (CA).
Bayatan said the mayor did not implement the resolution because of the injunction order issued by the CA on Aug. 16, 2007.
According to the legal officer, Esguerra filed it again at the Office of the President based on the letter dated March 21, 2017 of Atty. Ariel Ronquillo, CSC assistant commissioner, addressed to former city mayor Monico Puentevella.
Part of Ronquillo’s letter cited that a motion for reconsideration from the order of execution was filed by Leonardia.
He posited that he filed a petition for review before the CA. He also alleged that the CA issued a notice requiring the commission to comment on the petition for review, said Ronquillo.
The letter further stated that upon checking the records, the commission did not receive any directive from the CA. What the commission received was a summon dated April 24, 2007 from the RTC, Branch 46, relative to the Special Civil Action for Prohibition with prayer for the issuance of temporary restraining order filed by Zamora against CSC Region 6.
Thus, in the absence of any restraining order or injunctive writ issued by any court for the purpose, the agency issued Resolution No. 071540 dated Aug. 6, 2007, denying the motion of Leonardia./PN
