ILOILO — With two February holidays approaching, the Department of Labor and Employment (DOLE) in Western Visayas has issued a labor advisory reminding employers of the specific wage rules that apply on February 17 and February 25, cautioning businesses to ensure correct holiday pay and avoid labor disputes.
Labor Advisory No. 01, Series of 2026 spells out the pay computation and work rules for the Special (Non-Working) Day on February 17, 2026 (Chinese New Year) and the Special (Working) Day on February 25, 2026 (EDSA People Power Revolution Anniversary).
For February 17, a special non-working day, the “no work, no pay” principle applies unless company policy, established practice, or a collective bargaining agreement (CBA) provides otherwise.
Employees who report for work are entitled to 130 percent of their basic wage for the first eight hours (Basic Wage x 130%).
Work beyond eight hours must be paid an additional 30 percent of the hourly rate (Hourly Rate x 130% x 130% x number of overtime hours).
If the day falls on an employee’s rest day, pay increases to 150 percent of the basic wage for the first eight hours, with overtime computed on top of the adjusted rate.
For February 25, classified as a special working day, the advisory states that it is treated as an ordinary working day.
Employees who work receive 100 percent of their basic wage for the first eight hours, while overtime work earns an additional 25 percent of the hourly rate (Hourly Rate x 125%).
The “no work, no pay” rule likewise applies unless a company policy or CBA provides otherwise.
DOLE said the advisory is meant to guide both employers and workers on their rights and obligations during the upcoming holidays, emphasizing proper compliance with labor standards to maintain fair and orderly workplace relations as the country marks culturally and historically significant occasions./PN
