ILOILO City – Workers who decide not to report for duty due to dangerous weather conditions cannot be penalized, the Department of Labor and Employment (DOLE) has reminded private employers.
The guidance is anchored on Labor Advisory No. 17, Series of 2022, which lays down the rules on work suspension and employee rights during severe weather.
It was reiterated while Tropical Depression “Verbena” brought rains and winds across Western Visayas yesterday.
On November 25, Iloilo, Capiz, Aklan, Antique, Guimaras, and Negros Occidental were under Tropical Cyclone Wind Signal No. 1 as Verbena moved west-northwest and gradually intensified as it neared Palawan.
The weather bureau warned of rains, possible flooding, and gusty conditions.
According to DOLE, employers may order work suspension at their discretion to keep workers safe, following coordination with their designated safety officers.
Employees who skip work during hazardous conditions generally do not receive regular pay unless covered by favorable company rules or through the use of leave credits. Those who report for work and complete at least six hours are entitled to full compensation; shorter work hours merit proportionate pay.
The department emphasized that choosing to stay home due to imminent weather-related danger “shall not be subject to any administrative sanction,” underscoring the importance of protecting workers’ welfare during storms and similar emergencies.
