BACOLOD City – Lawyer Cesar Beloria Jr. wanted to clarify the accusations Michael Gebusion included in a police report.
Beloria and Sevilla Cordova commanded eight unidentified men and 10 security guards to destroy the concrete perimeter fence of the compound in Barangay Villamonte around 9:30 a.m. on Sept. 2, a Police Station 4 report showed.
Gebusion asked from them a writ of execution but the men failed to present one. He then filed a complaint against the men and the guards’ employer, the DSR and Investigation Agency, before the police station.
In a letter, Beloria told Panay News the property was owned by Tyrone Co, based on the Transfer Certificate of Titles issued to the latter in 1994.
The perimeter fence, on the other hand, was owned by the Uy family who owns a building next to the compound.
Rhodora Rojo, representing the Uy family, allowed Beloria and his men to “partially and temporarily” take down the perimeter fence, Beloria clarified.
The lawyer said that while the property was under dispute, there was no legal obstacle on the part of the owner to perform such action.
The civil case for a temporary restraining order and preliminary injunction lodged by Gebusion was denied, Beloria added.
“The activity on Sept. 2, 2017 is for the land filling only and does not involve any demolition of any structure, except, the perimeter fence alone,” Beloria explained in the letter.
He also said Co was the one paying the land taxes of the property./PN
