MANILA – The camp of Mayor Jed Patrick Mabilog will file today a petition for a writ of certiorari before the Court of Appeals (CA) seeking a review of the Office of the Ombudsman’s ruling dismissing Iloilo City’s chief executive from the service for dishonesty and unexplained wealth.
“We are filing for certiorari under Rule 65 grounded on inordinate delay, and no authority to sign from Carandang,” Mabilog’s legal counsel Joenar Pueblo told Panay News yesterday.
Overall Deputy Ombudsman Melchor Arthur Caranding approved the decision penned by Rachel Cariaga-Favila, graft investigation and prosecution officer III, on the complaint filed against Mabilog for dishonesty and grave misconduct.
Pueblo said in a recent press conference that, “May provision sa Ombudsman law that with regards to officials of municipalities and local governments, the Ombudsman is the one who signs orders and resolutions. Wala sia may ginhambal nga deputy or overall deputy Ombudsman, only the Ombudsman.”
The one who should have signed the ruling was Ombudsman Conchita Carpio-Morales because Mabilog was a local government officer, he stressed.
This matter alone would make the Ombudsman decision on Maiblog null and void for violating the Ombudsman law, said Pueblo.
According to the Ombudsman ruling, Mabilog failed to sufficiently explain how his net worth increased by P8,938,082.52 from 2012 to 2013.
Spokesperson Mark Piad, meanwhile, said the mayor’s return to the country has not been discussed yet.
After his Sept. 11 to 30 sick leave citing his diabetes, Mabilog decided to extend his furlough abroad up to Oct. 30.
“What we discussed was only about the case. That is our top priority,” Piad told Panay News.
Friday last week, President Rodrigo Duterte said the Ombudsman’s order to dismiss Mabilog was a “very, very late gesture.”
“Kita mo si Mabilog? Mabilog is, I think a cousin of Drilon, wala na. The Ombudsman, in a very, very late gesture, para kunwari na sinuportahan nila ako, fired, stripped him of his mayorship,” he said.
Mabilog has been linked by the President to illegal drugs as protector, a charge that the Iloilo City mayor vehemently denied./PN
