BACOLOD City – The Social Action Center (SAC) of the Diocese of Bacolod filed a supplemental motion for reconsideration (MR) against an order that the Energy Regulatory Commission (ERC) issued on June 27.

The supplemental MR filed on Nov. 7 is in relation to the one that SAC filed on Oct. 4, which challenged the ERC order authorizing the Central Negros Electric Cooperative (Ceneco) to collect from its member-consumers a monthly P0.0817 extra fee for 50 months until an amount of P232,010,090 is gathered.

The accumulated amount is supposed to be used for Ceneco’s unpaid contract balance with Kepco Salcon Power Corp. (KSPC), covering the period July 26, 2011 to Nov. 25 2013.

Atty. Vicente Petierre III – SAC’s legal counsel – said the supplemental MR points out that KSPC did not generate the power supply covering the period.

Ceneco was not also able to deliver the supply to its member-consumers, stressed Petierre, adding that the extra fee collection was thus “unfair.”

Moreover, Petierre said Ceneco and KSPC signed the contract on July 29, 2011 and not July 26 on the same year.

“The contract has a retroactive effect,” Petierre said.

He added that the transaction was made between Ceneco and KSPC. Thus, Ceneco officials must pay the balance and not burden a third party, which in this case are member-consumers./PN
