BACOLOD City – City Prosecutor Juliana Carbon may return as general manager of the Bacolod City Water District (Baciwa) after she submits clearances from the Department of Justice (DOJ), the Baciwa Board of Directors said.
In a resolution approved yesterday, the Board affirmed the Civil Service Commission (CSC) order dated June 26 reinstating Carbon to her former position at the water district.
“We do not have any alternative. This action of the Board is legal,” said Baciwa Board chairman Lorendo Dilag.
Dilag added that Carbon must secure clearances from the DOJ to avoid charges of abandonment and unlawful appointment.
Carbon promised to submit the clearances before Aug. 21, the day she is supposed to return at Baciwa.
But since that day is a holiday, Carbon will report the following day instead, Baciwa Board member Mona Dia-Jardin said.
A CSC decision promulgated on July 12 also ordered Baciwa to pay Carbon’s back salaries from Aug. 18, 2015 until her actual reinstatement.
On the other hand, Atty. Aldrid Antiquiera, Mario Macatangay’s legal counsel, wrote a letter to Dilag yesterday opposing Carbon’s return.
Macatangay’s appointment as Baciwa interim general manager was invalidated by the CSC in view of Carbon’s reinstatement to the water facility.
Macatangay filed a petition against the CSC and Carbon for certiorari and injunction at the Court of Appeals in Cebu City, the letter read.
But Dilag said even with Macatangay’s petition, the Board must abide with the CSC order.
Moreover, Macatangay filed a leave of absence for two weeks starting yesterday, Dilag said.
Assistant general manager Samuel Penado was designated as Baciwa’s officer-in-charge, he added./PN
