MANILA – The National Bureau of Investigation (NBI) filed criminal charges against four Caloocan City policemen who shot and killed the 17-year-old Kian delos Santos in an antidrug operation.
Caloocan City police station 7 head Chief Inspector Amor Cerillo, Police Officer 3 Arnel Oares, Police Officer 1 Jerwin Cruz, and Police Officer 1 Jeremias Pereda were accused of murder, violation of domicile and planting of evidence.
These were the second set of charges lodged against the officers before the Department of Justice following the murder and torture cases filed by the Public Attorney’s Office.
The Justice department plans to consolidate the two sets of cases.
The policemen were liable for murder, the NBI said, citing forensic findings that showed delos Santos was shot while kneeling and the shooter was standing or positioned on the left side of the victim.
“The bullet marks on the concrete wall beside Kian, the trajectory of the bullets in the head of Kian and the bloodstains just below the bullet dent prove an undisputable conclusion that Kian was shot while somewhat in a kneeling/fetal position,” the NBI said.
Earlier, the officers claimed delos Santos, whom they tagged as a drug runner, resisted arrest and engaged them in a shootout.
“If Kian indeed engaged them in a shootout, he would have sustained gunshot wounds on the frontal parts of his body,” said the NBI. “It was highly improbable for Kian to conceal a .45-caliber pistol including two sachets of alleged shabu on his waist as he was wearing only boxer shorts at the time.”
The violation of domicile charge was filed against the policemen for unauthorized entry of a dwelling, while the planting of evidence was in violation of Section 29 of the Comprehensive Dangerous Drugs Act of 2002.
Philippine National Police spokesman Chief Superintendent Dionardo Carlos welcomed the filing of charges. This will give the officers a chance to defend themselves in court, he said./PN
