CEBU City – All suspended officials in Barangay Ermita are staying put.
The Department of the Interior and Local Government (DILG) Region 7 declared a “status quo” in the barangay government.
Regional Director Rene Burdeos said they will not carry out the six-month preventive suspension of the village officials pending review and clearance by the DILG central office and the Office of the President.
This means the officials may continue performing their functions and responsibilities, he stressed.
DILG Region 7 legal officer Aiza Fiel Nogra said they submitted to the central office on Monday a situationer, with recommendation to Secretary Ismael Sueno and for consideration of President Rodrigo Duterte.
The Office of the Ombudsman – Visayas ordered suspended Ermita barangay captain Felicisimo Rupinta and all seven councilmen for failure to cooperate in an antidrug operation.
Also suspended were kagawads Marky Rizaldy Miral, Antonieto Flores, Ryan Jay Rosas, Alio Tamundo, Domingo Ando, Maria Bianghug, and Wilbert Flores.
Burdeos said the only legal basis to appoint replacements is Article 8, Section 16 of the 1987 Constitution, considering that all of the elected officials were suspended and their suspension was only preventive and temporary.
“Under this law, and with his residual power, only President Rodrigo Duterte or his alter ego, Secretary Ismael Sueno, can appoint replacements,” said Burdeos. (PNA)
