MUCH to the dismay of those that hate him, President Rodrigo Duterte placed the entire island of Mindanao including Basilan and Tawi-Tawi under martial law last Tuesday. This was in response to the bloody attack of the ISIS wannabe Maute group on Marawi City.

The emergency declaration took immediate effect and will last for 60 days, according to presidential spokesman Ernesto Abella, who made the announcement on Tuesday from Russia, where Duterte was on a scheduled four-day official visit.

The President “has already declared martial law for the entire island of Mindanao”, Abella said.

“This is possible on the grounds of the existence of rebellion,” he added.

The President said on Wednesday martial law could last a year as he vowed it would be similar to the late Ferdinand Marcos dictatorship.

“To those who have experienced martial law, it would not be any different from what President [Ferdinand] Marcos did,” Duterte said. “I’ll be harsh.”

“If it would take a year to do it, if it’s over within a month, then I’d be happy,” Duterte said in a video posted online by the government.

As expected, the usual idiots and “devotees to the yellow ribbon” are quick on the draw to complain and come up with all sorts of conspiracy theories most of them bordering on the absurd when really the only reason they do this is because they hate President Rodrigo Duterte.

Of course, these idiots are cheering the Maute group to continue the killing and burning in Marawi City hoping it would bring the fall of President Rodrigo Duterte as should that happen it would give then pure orgasmic pleasure.

Take the best orgasm you ever had, multiply it by a thousand and you’re still nowhere near it,” this line from Trainspotting probably best describes how the “yellow ribbon devotees” feel should Duterte fall.

The most glaring thing is that while almost all of Mindanao are happy and fully supportive of this declaration of martial law by President Rodrigo Duterte, the usual idiots that have been complaining are not even from Mindanao.

I can only speculate that these idiots and “yellow ribbon devotees” have never gotten over their perceived bogey man, the late President Marcos who declared martial law in 1971 based on the 1937 constitution.

I wonder if these folks are aware that we now have a different Constitution, the 1987 one which was ratified during the term of their patron saint former President Cory Aquino.

From PhilStar Global here’s an explanation on the martial provision of the 1987 Constitution which gave President Rodrigo Duterte the power to place Mindanao under martial law:

According to Article VII, Section 8 of the 1987 Constitution, this, and the suspension of the writ of habeas corpus, can only be done ‘in case of invasion or rebellion, when the public safety requires it.’” 

The President must also submit a report to Congress, whether in person or in writing, within 48 hours of the declaration. If Congress does not agree that martial law should be declared or the writ of habeas corpus suspended, it can “voting jointly, by a vote of at least a majority of all its members in regular or special session” revoke the proclamation or suspension.

No declaration of martial law or the suspension of the writ of habeas corpus can last for more than 60 days unless a majority in Congress, again voting jointly, votes to extend it “if the invasion or rebellion shall persist and public safety requires it.”

The proclamation of martial law or the suspension of the writ may be reviewed by the Supreme Court “for the sufficiency of the factual basis” of the proclamation or suspension if a citizen petitions it to. It has 30 days to decide on whether the declaration or suspension has a basis.

 A state of martial law does not suspend the operation of the Constitution, nor supplant the functioning of the civil courts or legislative assemblies, nor authorize the conferment of jurisdiction on military courts and agencies over civilians where civil courts are able to function, nor automatically suspend the privilege of the writ,” the Constitution also says.

The writ of habeas corpus may only be suspended for people charged for rebellion or for offense connected to the invasion while those arrested while the writ is suspended should be charged within three days or must be released.

You can all now breathe a sigh of relief as this has happened before; remember the Maguindanao Massacre?

Then President Gloria Arroyo also declared martial law in Maguindanao and Lanao, arrested all the suspects without any hindrance while the rest of the country was business as usual.

But if the bleeding hearts and so-called human rights advocates complain about the Maute group being killed by government forces then perhaps these whiners i.e. Mr. Sharon Cuneta aka Kiko Pangilinan, Leah Navarro and Jim Paredes should just go to Marawi City and tell the Maute group to go home and plant camote instead.
