BACOLOD City – The Energy Regulatory Commission (ERC) cannot yet decide whether or not to approve the Central Negros Electric Cooperative’s (Ceneco) application to source from its member-consumers an extra fee until its P414-million under-recovery debt with power supplier Kepco-Salcon Power Corp is paid.
Atty. Rhett Roswell Mislang of the ERC, who served as the hearing officer, said Ceneco and the intervenors decided that they will submit their position papers.
The ERC will only issue its decision after these position papers are submitted, Mislang added.
The hearing was conducted yesterday at Ceneco’s main office along Mabini Street in the city for the ERC to whether or not approve the over/under-recoveries in the implementation of the automatic cost adjustments and true-up mechanisms and corresponding confirmation pursuant to ERC Resolution No. 16 series of 2009, as amended by ERC Resolution No. 21 series of 2016.
On Nov. 22, ERC commissioner Josefina Patricia Magpale-Asirit notified Ceneco and the intervenors – composed of Mayor Evelio Leonardia of Bacolod City, Elinore Cabanilla and Romeo Lavilla Sr. of the Social Action Center (SAC) of the Diocese of Bacolod, and representatives from the Bayan Muna Partylist – about the set hearing.
Mapale-Asirit also instructed Ceneco and the intervenors to bring their witnesses.
Ceneco filed its application for the under-recovery fee at the ERC on March 26, 2012.
On April 18, 2012, the electric cooperative also filed a motion for provisional authority before the ERC to recover from member-consumers the under-recoveries so that it can pay its debt.
The June 2, 2012 hearing on Ceneco’s application was the first of the many that the ERC has conducted, according to Leomel Tambanillo, Ceneco Plan Department manager.
During the hearing, Tambanillo explained that the if there is an under-recovery, Ceneco will be paying it by adding a certain amount to the monthly bills of member-consumers but if there is over-recovery, Ceneco will have to refund the consumers the amount.
It was, however, not clear if how under-recovery and over-recovery will be determined.
Also during the hearing, SAC legal counsel Vicente Petierre III filed a manifestation to clarify the issue because it is “highly technical.”/PN
