MANILA – The Sandiganbayan dismissed on Thursday a graft case against former Makati mayor Dr. Elenita Binay in connection with the alleged anomalous procurement of P21.7 million worth of furniture for the Makati City Hall.
Voting 3- 2, the anti-graft court granted Binay’s demurrer to evidence due to the failure of prosecutors to prove that the 2000 public bidding for the furniture was rigged, according to Atty. Leizel De Leon, Sandiganbayan clerk of court.
The Sandiganbayan also said the alleged rigged bidding would not constitute proof beyond reasonable doubt.
Also cleared from Binay’s graft case are former city councilor Salvador Pangilinan, ex-city hall officials Ernesto Aspillaga, Nicanor Santiago, and Asia Concept International Inc. officers Beda Aquino and Bernadette Aquino.
Binay has a remaining malversation of public funds case involving allegedly questionable hospital equipment transactions.
In the 2006 case, the Ombudsman alleged Binay was involved in the rigged bidding for office partitions and furniture. The Ombudsman also alleged that Binay conspired with three city officials in simulating the bidding in favor of Asia Concept. (ABS-CBN News)
