ILOILO City – The Sangguniang Panlungsod (SP) wants former councilor Lyndon Acap to fill in the vacancy in the city council created by the assumption to the vice mayorship of then councilor Jeffrey Ganzon.

SP members yesterday voted in favor of the resolution introduced by Councilor R Leone Gerochi endorsing Acap.

According to Gerochi, a member of the Liberal Party (LP), he sought the counsel of party mates and senators Franklin Drilon and Francis Pangilinan regarding the vacant SP seat and was advised to make a nomination.

Under the rules of succession in the Local Government Code, the party of the SP member who caused the vacancy should be the one to nominate a replacement.

Ganzon ran for city councilor last year under the LP but recently abandoned the party and expressed intention to become a member of the Partido Demokratiko Pilipino – Lakas ng Bayan of President Rodrigo Duterte.

According to Gerochi, Acap, an LP member since 2010, was qualified for the post and thus nominated him.

Ganzon would have wanted that he himself nominate his replacement in the SP because “the one who caused the vacancy has the right to recommend.”

Gerochi and councilors Plaridel Nava and Joshua Alim, however, reminded him of the rules set by the Local Government Code.

“It is very clear…we have no choice. It is stated in law,” said Nava.

Ganzon suggested that each SP member make a nomination and “let the President choose.”

President Rodrigo Duterte is the final approving authority on Ganzon’s replacement in the SP. But Nava said the President has “no other option” but act only on the nomination made by the LP.

Reached for his comment, Acap said he would like to head the SP committee on police matters should his return to the city council materializes.
