BACOLOD City – A 62-year-old American arrested in Barangay Taculing for uploading videos of him having sex with different partners was facing a fine of up to half a million pesos, jail time of up to seven years and deportation.
Lee David Colglazier has been charged with violation of Republic Act 9995, or the Anti-Photo and Video Voyeurism Act of 2009.
Operatives of the National Bureau of Investigation (NBI) swooped down on the house the foreigner from Illinois, United States was renting last week.
One of the women Colglazier allegedly paid to have sex with him complained to the NBI.
The woman claimed the American uploaded videos of them having sex into the internet without her permission, NBI-Bacolod head Renoir Baldovino told Panay News yesterday.
Judge Raymond Joseph Javier of the Regional Trial Court Branch 52 issued the search warrant the NBI used in raiding Colglazier’s rented house and seizing his laptop computer and mobile phone on May 12.
Colglazier was detained in the NBI-Bacolod office.
The following day, the NBI-Bacolod filed the criminal charge against the American before the City Prosecutor’s Office.
Colglazier’s arrest came exactly a week after police officers caught three people allegedly engaged in cybersex in Barangay Handumanan.
The American may be released from detention if he can post the bail bond worth P120,000, Baldovino told Panay News.
The Anti-Photo and Video Voyeurism Act of 2009 declared it unlawful for any person:
* to take photo or video coverage of a person or group of persons performing sexual act or any similar activity or to capture an image of the private area of a person/s such as the naked or undergarment clad genitals, public area, buttocks or female breast without the consent of the person/s involved and under circumstances in which the person/s has/have a reasonable expectation of privacy
* to copy or reproduce, or to cause to be copied or reproduced, such photo or video or recording of sexual act or any similar activity with or without consideration
* to sell or distribute, or cause to be sold or distributed, such photo or video or recording of sexual act, whether it be the original copy or reproduction thereof
* to publish or broadcast, or cause to be published or broadcast, whether in print or broadcast media, or show or exhibit the photo or video coverage or recordings of such sexual act or any similar activity through VCD/DVD, internet, cellular phones and other similar means or device
These prohibitions “shall apply notwithstanding that consent to record or take photo or video coverage of the same was given by such person/s,” stated the law.
Anyone found guilty of violating the law shall be meted with “imprisonment of not less than three years but not more than seven years” or “a fine of not less than P100,000 but not more than P500,000,” or both, at the discretion of the court.
If the offender is a foreigner, they shall be subject to deportation proceedings after serving their sentence and payment of fines, the law stated.
If Colglazier cannot post bail, the NBI-Bacolod will turn him over to the Bacolod City District Jail as soon as the bureau receives his “commitment order,” said Baldovino.
The American will not be allowed to leave the Philippines pending the resolution of the case, the NBI official added.
Three minors were rescued during the May 5 operation in Handumanan, according to Senior Superintendent Jack Wanky, acting police director.
The Women and Children Protection Center – Visayas Field Unit 7 and the Bacolod City Police Office’s Women and Children Protection Desk (WCPD) led the operation in coordination with the WCPD at Camp Crame.
The suspects — aged 20, 35 and 43 years old — were detained at Police Station 10. Police refused to disclose their names.
The operation followed the arrest of a man in the United States for engaging in cybersex using videos and photos of a minor residing in this city.
Criminal charges for cybersex, child abuse and trafficking in persons have been filed against the suspects on May 6./PN
