ILOILO City – Twenty-five sachets of shabu were confiscated from three drug pushing suspects in Barangay San Antonio, Molo district. Two of them were minors.
The police carried out the buy-bust operation on Friday around 5 p.m.
The suspects initially sold a sachet of shabu – for P1,200 – to a buyer they did not know was an undercover police officer.
Twenty-four more sachets were seized from them. These were valued at a total of P25,000.
One of the minors was 16 years old while the other was 17.
The 16-year-old suspect was a resident of Barangay Alalasan, Lapuz district while the 17-year-old one was from Barangay Tanza Esperanza, City Proper.
Their other companion was 18 years old. Adrian Dela Cruz of Barangay Tanza Esperanza was detained at the Molo police station.
All three suspects face charges for violation of the Comprehensive Dangerous Drugs Act of 2002.
The spokesperson of the Police Regional Office 6 (PRO-6) said minors arrested in antidrug operations of the police will be slapped with appropriate charges.
It will be up to the prosecutor to appreciate the complaint filed, said Superintendent Gilbert Gorero.
Republic Act (RA) 9344 or the Juvenile Justice and Welfare Act of 2006 set the minimum age of criminal responsibility to 15 years old.
Section 6 of the Act as amended by RA 10630 states: “A child 15 years of age or under at the time of the commission of the offense shall be exempt from criminal liability. However, the child shall be subjected to an intervention program pursuant to Section 20 of this Act.”
A child above 15 years but below 18 years of age shall likewise be exempt from criminal liability and be subjected to an intervention program, unless he/she has acted with discernment, in which case, such child shall be subjected to the appropriate proceedings in accordance with the Act./PN
