I WRITE on behalf and in representation of my client, Mr. Ernesto M. Eco, also known as “Erning Ati”, a resident of Barangay Supa, San Jose, Antique, relative to an article consisting of a public and malicious imputation of a crime to my aforementioned client which you published under the column Lapsus Calami on page nine (9) of the September 5, 2017 issue of Panay News, a newspaper of general circulation in the province of Antique and in Western Visayas.

In the subject article, you alluded to my aforementioned client as one of two “drug lords” in the province of Antique and, thereby, you have not only jeopardized the personal safety and security but you have also caused the dishonor, discredited and contempt of my said client who, for like reason, has suffered besmirched reputation, sleepless nights, serious anxiety and similar injuries.

My client, Mr. Ernesto M. Eco, vehemently denies your false and unfounded imputation as he is a law-abiding citizen and an honest and hard-working businessman engaged in lawful undertakings who has no derogatory record, as shown by: (1) a CERTIFICATION dated February 3, 2017 of the San Jose Municipal Police Station; (2) a CERTIFICATE OF CLEARANCE dated February 9, 2017 of the Office of the Provincial Prosecutor of Antique; (3) a CLEARANCE dated September 15, 2016 of the National Bureau of Investigation ; (4) a COURT CLEARANCE dated February 9, 2017 of the Office of the Clerk of Court of Antique; and (5)  a CERTIFICATION dated February 3, 2007 of  the Office of the Clerk of Court, Regional Trial Court of Iloilo, copies of which are hereto attached and mad e parts hereof.

Under the obtaining circumstances I do hereby demand that you perform the legal and moral duty to similarly publish in Panay News an apology and a retraction on your part, which should: (a) include an admission of the falsity of the subject libelous action; (b) evince a desire to repair the wrong occasioned by such libelous article; and (c) express a pledge never to publish a similar imputation or allusion to my client.

Please be forewarned that if you fail or refuse to comply with the herein demand within fifteen (15) days from your receipt of this letter, my client would be constrained to cause the filing of civil and criminal actions against you before the appropriate fora in San Jose, Antique . – NERY G.
