ILOILO City – Mayor Rosario Mediatrix “Trixie” Fernandez of San Enrique, Iloilo has been slapped with P700,000 in fines after the Sandiganbayan found her guilty of violating government insurance and housing fund laws.
Her co-accused, Municipal Treasurer Imelda Mecisamente Celebrar, has been fined with the same amount.
Fernandez and Celebrar were guilty of 16 counts of violation of Section 52 (c) of Republic Act 8291, or the Government Service Insurance Act of 1997, the Sandiganbayan Second Division said.
Each of them will have to shell out P80,000 per count.
The anti-graft court also found them guilty of 11 counts of violation of Paragraph 1, Section 1, Rule XII of the Implementing Rules and Regulations of Republic Act 9679, or the Home Development Mutual Fund Law of 2009. Their fine reached P620,000 each.
Fernandez has not yet received an official copy of the Sandiganbayan decision, one of her staffers who refused to be identified told the press.
They learned about the decision only from the news and the copy released on the Sandiganbayan website, the staffer said.
The staffer assured that Fernandez will release a statement on the decision as soon as she receives her official copy.
The case stemmed from complaints from local government workers with regard to the allegedly delayed remittance of their P5.96 million worth of contributions to the Government Service Insurance System (GSIS) and Home Development Mutual Fund, more popularly known as Pag-IBIG Fund.
Fernandez and Celebrar failed to remit P5.34 million worth of GSIS contributions “within 30 days from the time they became due and demandable,” a report from the Office of the Ombudsman Special Prosecutor showed.
The amount covered the periods January to October 2011, April 2012, and June to October 2012.
The San Enrique officials also failed to remit P620,000 in Pag-IBIG contributions covering January, February, April, October, and December 2011, and January, February, August, September, October, and December 2012, the Ombudsman said./PN
