BACOLOD City – The Bacolod City Water District (Baciwa) will not go against the reinstatement of Juliana Carbon as general manager.
Its Board of Directors will not file any motion against the Civil Service Commission (CSC) central office order on Carbon’s return, according to Board chairman Lorendo Dilag.
The CSC order, released on July 12, also invalidated Mario Macatangay’s appointment in the water district.
It becomes final and executory without a motion for reconsideration filed or a restraining order issued against it.
The CSC also ordered Baciwa to pay Carbon her back wages from Aug. 18, 2015 until her reinstatement.
The order dismissed the petition for review filed by former Baciwa chairwoman Ma. Aida Torre for lack of merit.
In Decision No. 160061, CSC Region 6 rejected Macatangay’s extension as Baciwa interim general manager.
The CSC invalidated Resolution No. 160162 dated Sept. 20, 2016 appointing Macatangay as general manager, saying the position is not vacant in view of Carbon’s return.
Macatangay’s appointment violated Section 5, Rule VII of the Omnibus Rules Implementing Book V of Executive No. 292, and Section 13, Rule XIII of CSC Memorandum Circular No. 40.
For his part, Macatangay said he may not be able to file any motion against the CSC decision because he was “not a party to the case,” but he will consult a lawyer for any possible legal remedy./PN
