ROXAS City – Capiz governor Antonio del Rosario reminded local chief executives to make sure that there are no illegal structures in riverbanks in the province.
Del Rosario fielded this reminder during the recent meeting of the Provincial Peace and Order Council.
The Provincial Environment and Natural Resources reported that it has monitored 649 illegal structures, both concrete and semi-concrete, in rivers and riverbanks in Capiz.
According to Department of Interior and Local Government (DILG) assistant regional director and concurrent Capiz provincial director Maria Calpiza Sardua, the local chief executives – including the governor, mayors and village chiefs – can be held liable for their inaction on the illegal construction of structures in riverbanks.
Presidential Decree 1067, or the Water Code of the Philippines, provides that “the banks of rivers and streams and the shores of the seas and lakes throughout their entire length and within a zone of three meters in urban areas, 20 meters in agricultural areas and 40 meters in forest areas, along their margins, are subject to the easement of public use in the interest of recreation, navigation, floatage, fishing, and salvage.”
“No person shall be allowed to stay in this zone longer than what is necessary for recreation, navigation, floatage, fishing or salvage or to build structures of any kind,” part of the law that Sardua specified.
Moreover, PENRO Technical Services Division head Edwin Borja said they will monitor and inventory the illegal structures and settlers along riverbanks. (PIA/PN)
