MANILA – The Integrated Bar of the Philippines (IBP) filed on Monday criminal and administrative charges against six policemen in connection with the killing of 17-year-old Kian delos Santos in Caloocan City.
Administrative charges were lodged at the Office of the Ombudsman against former Northern Police District director Chief Superintendent Roberto Fajardo and former Caloocan police chief Senior Superintendent Chito Bersaluna.
Meanwhile, criminal charges were filed against Police Officer 3 Arnel Oares, Police Officer 1 Jeremias Pereda, Police Officer Jerwin Cruz, and Chief Inspector Amor Cerillo, all formerly with Caloocan Police Station 7.
All six officers were accused of grave misconduct and gross neglect of duty, while the latter four were facing additional charges for murder, child abuse, violation of domicile, and planting of evidence.
Oares, Pereda and Cruz were the three officers who allegedly conducted the antidrug operation on Aug. 16 where delos Santos was killed. Cerillo was their station commander.
The officers claimed delos Santos put up a fight but security camera footage and witness accounts said otherwise.
A certain Nono Lubiran, the one who pointed to delos Santos during the operation, was also facing criminal charges.
IBP president Abdiel Dan Elijah Fajardo said they based their complaint on the testimony of three witnesses: “two minors and one adult who can barely read and write.”
These three witnesses were the same ones under the custody of the Senate through the office of Risa Hontiveros, Atty. Fajardo said.
The case the IBP filed had nothing to do with Hontiveros. They interviewed the witnesses at the Child Custody Unit of the Philippine General Hospital, he said.
“The IBP hopes that with these affidavits, the Ombudsman can be completely guided whether it can assume jurisdiction in filing murder cases or possibly their removal from office,” said Atty. Fajardo.
Meanwhile, the Philippine National Police’s Internal Affair Service (PNP-IAS) found probable cause to file administrative charges against 16 police officers in connection with delos Santos’ killing.
Inspector General Alfegar Triambulo of the PNP-IAS said the officers may face charges for grave misconduct, serious irregularity in the performance of duty and serious neglect of duty. (Adrian Stewart Co and ABS-CBN News/PN)
